Motorists could be hit with a hefty penalty for something most don’t think twice about when it rains

Drivers could face fines of up to £2,500, penalty points and even disqualification if they fail to follow one overlooked driving rule when it rains. The warning relates to a little-known requirement around windscreen wipers which motorists only think about when they stop working – and experts say it could land drivers in serious trouble.
The rule comes under Regulation 34 of the Road Vehicles (Construction and Use) Regulations 1986 which states that all vehicles must be kept in roadworthy condition with properly functioning equipment. According to official government guidance, windscreen wipers and washers must be “maintained in efficient working order” at all times when a vehicle is used on the road.
RAC warn that if a fault is serious enough – such as driving in heavy rain with a failed wiper motor – it could be treated as driving a vehicle in a dangerous condition. That offence can carry a discretionary driving ban, points and fines up to £2,500 depending on severity.
The motoring organisation has previously warned that faulty wipers and washer systems are one of the most common preventable defects seen on UK roads. RAC says many drivers wrongly assume such issues are only relevant during an MOT, when in fact they apply every time a vehicle is driven.
Research also suggests poor visibility plays a major role in road collisions, particularly during heavy rainfall and winter conditions. According to RAC data, roads see hundreds of thousands of breakdown-related incidents each year, many of which are linked to avoidable maintenance issues.
Highway Code Rule 229 further reinforces a driver’s need to “see clearly” before setting off in poor weather. Drivers are advised to regularly check wiper blades for wear, ensure washer fluid is topped up and replace faulty components immediately. Even minor issues such as streaking blades or blocked jets can quickly reduce visibility in heavy rain.
Safety organisations also recommend carrying spare washer fluid and ensuring demister systems are working properly before setting off. The AA has repeatedly warned that poor preparation in wet weather significantly increases breakdown and accident risk.
As millions of drivers are on the road daily, authorities stress that something as simple as a faulty wiper could escalate into a serious safety hazard. It risks not only your money and driving licence, but your livelihood.
