You signed an order,\u201d Burton allegedly wrote in one of the texts, which was sent to Gustin on March 14.<\/p>\n<p>\u201cSo the response should have been hey brook your dad has you a lot in the summer.. but I know your priority is not having her spend time with us. So now you\u2019ll be able to say you made a mistake and we should schedule my weeks.\u201d<\/p>\n<p>In response, Gustin told her ex \u2014 who moved to Tennessee \u2014 that their pre-teen wanted to be a part of a junior lifeguards program where they live in California. <a><br \/><\/a><br \/>\u201cNo it\u2019s not. I told you she wanted to do jr guards,\u201d she allegedly wrote, per docs obtained by TMZ. \u201cYou knew this. You are the one who decided to move. Her life is here. She\u2019s going to be more involved in things.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>Burton (seen above with his ex and Brooklyn) claimed Gustin was blocking his visitation time with his daughter. <span class=\"credit\">1shereeburton\/Instgram<\/span><\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>Gustin (pictured above with Burton in February 1999) claimed Brooklyn wanted to join a summer program in California, where they live. <span class=\"credit\">Ron Galella Collection via Getty Images<\/span><\/figcaption><\/figure>\n<p>The mom of five told Burton she was \u201cwilling to work\u201d with him, but argued that Brooklyn \u201cshouldn\u2019t be limited to activities she wants to do\u201d because he \u201cinsist[s]\u201d on her being in Tennessee.<\/p>\n<p>\u201cThat\u2019s not right or fair to her,\u201d she concluded. \u201cPlease just enjoy your weekend with your daughter. I\u2019m done talking about this.\u201d<\/p>\n<p>In another message obtained by the outlet, Burton claimed Gustin has \u201cnever been willing to work\u201d with him on \u201canything.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>Burton (seen above with his ex) asked the court to order Gustin to follow their custody agreement and allow his custodial time this summer. <span class=\"credit\">1shereeburton\/Instgram<\/span><\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>The exes share kids Brooklyn, Jack, 20, and Makena, 22 (as seen above). <span class=\"credit\">1shereeburton\/Instgram<\/span><\/figcaption><\/figure>\n<p>\u201cIf you were, we never would\u2019ve gone to court in the first place just to see my daughter,\u201d he allegedly said.<\/p>\n<p>Earlier this week, the \u201cLast Castle\u201d actor, 55, filed court documents claiming Gustin was interfering with his custodial time with Brooklyn, per TMZ.<\/p>\n<p>He asked for a judge\u2019s assistance with getting his ex-wife to comply with their custody agreement \u2014 which they finalized in December 2023 \u2014 that states that they will share joint legal and physical custody of their two minor children, Brooklyn and Jack, who was 17 at the time. (They\u2019re also parents to 22-year-old daughter Makena.)<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>In 2022, Burton announced he was divorcing his then-pregnant wife, Gustin (seen above with her ex-husband), after learning that she was carrying a child who was not his. <span class=\"credit\">1shereeburton\/Instgram<\/span><\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>They\u00a0finalized their divorce\u00a0in December 2023. (Pictured: Burton, Gustin and their kids.) <span class=\"credit\">1steveburton\/Instagram<\/span><\/figcaption><\/figure>\n<p>Burton claims Gustin has refused to give him their daughter this summer, and instead enrolled Brooklyn in a six-week program in California that conflicts with the time she would be in Tennessee with her dad. <\/p>\n<p>Burton asked the court to order Gustin to follow their custody agreement and to sanction her for $5,000.<\/p>\n<p>\u201cI wanted to clear something up. Sheree and I are separated,\u201d he wrote on his Instagram Story at the time. \u201cShe recently announced that she\u2019s expecting her 4th child.
