He had previously told passengers to &#8216;move out my f****g way&#8217; having consumed gin and vodka during the flight.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">He also admitted to smoking a &#8216;spliff&#8217; before boarding the New York to Heathrow flight. Uxbridge magistrates&#8217; court was told how the 31-year-old was caught vaping in the toilet towards the end of the flight in November 2025 before taking the wrong seat.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Once the plane touched down, he attempted to make his way back to his correct seat \u2014 but was forced to push through a packed aisle. The court heard that the incidents occurred during a six-hour overnight flight BA172 from New York&#8217;s JFK airport to London Heathrow on 23rd November 2025.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Flight attendants were preparing for landing at around 8am when they noticed Gaston had left his seat. Giving evidence in court, a cabin crew member recalled how she discovered the defendant in the aircraft&#8217;s toilet and knocked on the door, instructing him to return to his seat so the plane could land.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">However, when he opened the door, the lead cabin crew member said she could smell &#8216;a weed smell&#8217;, likened to that of CBD oil, and see a &#8216;vapour mist&#8217; in the toilet, before Gaston shut the door once more. In court, Gaston maintained that the smell and vapour were simply the plane&#8217;s air freshener, which he had sprayed after &#8216;relieving his bowels&#8217;.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Yet both the lead cabin crew member and a colleague stated it bore no resemblance to the air freshener used on their aircraft. A second crew member then pushed the bifold door open and again ordered Gaston to return to his seat, at which point he shouted, accused the flight attendant of coming on to him, and threatened to lodge a complaint.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">The court also heard that Gaston had admitted to being a regular cannabis smoker who &#8216;smoked a spliff&#8217; in New York before boarding his flight home, and had consumed &#8216;two or three&#8217; gin and tonics along with some vodka during the flight. However, he refuted claims he was intoxicated on board. Gaston then settled into a seat close to the lavatory and disregarded instructions to fasten his seatbelt, the court heard \u2013 with a fellow passenger eventually securing it for him.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Following touchdown, the court heard that Mr Gaston had &#8216;forced his way&#8217; through &#8216;very full&#8217; aisles as he attempted to return to his allocated seat to retrieve his hand luggage while the aircraft waited for roughly an hour for buses on the tarmac.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">A couple of rows ahead of his seat, American husband and wife Zachary Lowry and Laurel Dillon, requested Mr Gaston wait to pass through as the aisle was extremely congested. Yet Mr Gaston acknowledged he decided to barge past them to reach his seat.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Unable to locate his bag, he repeatedly threatened the pair and pushed past them &#8216;three or four&#8217; times, the court heard. On the final instance, Gaston placed his hand on Ms Dillon&#8217;s arm and hip and shoved her into her seat with such force that she subsequently suffered bruising.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">At court, Gaston disputed pushing either party with any force beyond &#8216;brushing past&#8217; them, but acknowledged he had stated &#8220;move out of my f****** way,&#8221; or &#8220;let me f****** get by&#8221;. Speaking to the court via video link from the United States, emotional New Yorker Ms Dillon recounted Gaston making repeated threats towards her and her husband. She said: &#8220;He was attempting to push past me, and I turned and said there is nowhere to move, please go to your seat, which we had at that point discovered was behind us. He threatened and said &#8216;you do not want to see me off this plane, you had better move or I will hurt you&#8217;, something to that effect.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">&#8220;The words that were used were &#8216;you don&#8217;t want to see me off this plane, you are so lucky we are in here right now, and as soon as we get out of there there will be another story.&#8221;<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Ms Dillon added that Mr Gaston had also said: &#8220;If you do not make room, I&#8217;m going to make room, and I will bash your heads together.&#8221;<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Mr Lowry described being shoved by Mr Gaston as leaving him feeling uncomfortable, embarrassed and frustrated. Also appearing via video link from the US, he said: &#8220;We ended up leaving the plane in a police van, but if we&#8217;d left regularly I was planning to make sure we weren&#8217;t being followed, to potentially get away from the individual and [his] associates.&#8221;<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">During cross-examination by prosecutor Rachel Dudley, Mr Gaston denied vaping on the aircraft, claiming that Mr Lowry, described as being six-foot tall, had &#8216;forcefully tried to block&#8217; him from reaching his seat. Defence solicitor Stacey McAdam contended that the case had not been proved beyond reasonable doubt, arguing that no one had witnessed her client vaping, that he may not have heard the knocks on the toilet door, and maintaining that he did put his seatbelt on. She argued that Ms Dillon and Mr Lowry &#8216;could&#8217;ve accommodated him as he tried to get by, but chose not to&#8217; and that her client denied making any of the threats. However, District Judge Kathryn Verghis found Gaston guilty on all four counts beyond reasonable doubt.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Setting out her reasoning, she stated: &#8220;I come to the conclusion that you were vaping, you were then uncooperative sitting, so much so a passenger helped you. This gives a very clear picture of your defiant, angry, confrontational behaviour.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">&#8220;I&#8217;m satisfied you were angry and confrontational, you did use bad language.
