confidentiality and privacy,\u201d Leutto, who does not represent either party, told us. \u201cThis may include non-disparagement or non-disclosure terms related to their relationship.\u201d <\/p>\n<p>However, Luetto explained that there are \u201csome exceptions\u201d to the enforceability of those provisions under the law. <\/p>\n<p>\u201cIn Taylor\u2019s case, she would likely not want to include provisions limiting her from singing about her relationship in songs, particularly since there is always so much speculation about the subjects of her songwriting,\u201d Luetto said. href=\"https:\/\/pagesix.com\/2025\/10\/03\/entertainment\/taylor-swift-releases-the-life-of-a-showgirl-all-the-songs-about-fiance-travis-kelce\/\"> several songs about Kelce <\/a>in 2025\u2019s \u201cThe Life of a Showgirl,\u201d and <a href=\"https:\/\/pagesix.com\/2024\/04\/19\/entertainment\/taylor-swifts-ttpd-relationship-breakdown-by-track\/\">some biting lyrics about exes Joe Alwyn and Matt Healy<\/a> on 2024\u2019s \u201cThe Tortured Poet\u2019s Society.\u201d<\/p>\n<p>Similarly, the legal eagle shared that celebrities often want to limit and clarify what constitutes as community\/marital property to \u201cavoid future claims to their creative work.\u201d <\/p>\n<p>\u201cParticularly when it comes to sequels and prior projects,\u201d she said. \u201cFor example, if Taylor had re-recorded one of her albums during marriage, there would be an argument that the re-record was partially a marital asset.\u201d<\/p>\n<p>An NDA included in the prenup could also prevent the singer and Kansas City Chiefs star from divulging the terms of their agreement to anyone else, aside from their respective legal representatives and accountants involved in the execution of the prenup or potential dissolution proceedings. <\/p>\n<p>\u201cSimilarly, they may include terms requiring mediation or, in states where permitted, the use of a private judge for any dissolution proceedings,\u201d Luetto said, adding, \u201cFor a high-profile couple like Swift and Kelce, privacy provisions of this nature would be particularly valuable in shielding the details of any potential dispute from public scrutiny.\u201d<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Swift (seen here with Kelce in 2024) included several lyrics href=\"https:\/\/pagesix.com\/2024\/04\/02\/entertainment\/taylor-swift-becomes-a-billionaire-as-she-makes-forbes-list\/\">billionaire Grammy-winner<\/a> having a much higher net worth than millionaire Kelce, <a href=\"https:\/\/pagesix.com\/2026\/05\/19\/entertainment\/why-billionaire-taylor-swift-could-be-on-the-hook-for-travis-kelces-living-expenses-after-wedding\/\">Swift may also be responsible footing his bill. <\/a><\/p>\n<p>\u201cWhen one party is worth significantly more than the other, prenuptial agreements frequently provide that the wealthier party will pay all of the couple\u2019s living expenses while the less wealthy party preserves their separate estate,\u201d Luetto said. <\/p>\n<p>Some agreements are also structured for the wealtheir preson to gift or transmute a portion of their estate to the community or to the other party\u2019s separate property. <\/p>\n<p>This would allow \u201ceach party to maintain investments and assets during the marriage,\u201d Luetto said, noting, \u201cThe amounts transmuted or gifted often increase over time, reflecting the duration of the marriage.\u201d<\/p>\n<p>In this A-list couple\u2019s case, Luetto said its likely they would not combine their estates when they tie the knot. <\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-large\"><figcaption>Swift (seen here with href=\"https:\/\/pagesix.com\/2025\/05\/30\/entertainment\/taylor-swift-announces-she-bought-back-her-masters-with-heartfelt-note-to-fans-bursting-into-tears\/\">buy back her masters<\/a>\u00a0and protect her music catalog \u2014 it is likely that any prenuptial agreement would keep their respective estates entirely separate, regardless of any efforts made by either party to enhance the other\u2019s estate during the marriage,\u201d Luetto said<\/p>\n<p>However, they could include terms allowing them to enter into joint ventures during their marriage.<\/p>\n<p>\u201cThey would simply need to clarify their ownership interests in any jointly held assets on a case-by-case basis,\u201d Luetto explained.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter the duo can also include clauses that state which jurisdiction\u2019s laws will be interpreted and enforced if there is a dispute in the future, which are called \u201cchoice-of-law provisions.\u201d  <\/p>\n<p>Swift has homes in New York, Rhode Island, Tennessee and Los Angleles while Kelce has properties in Leawood, Kansas, Missouri and Florida. <\/p>\n<\/p><\/div>\n<p><a
