{"id":515,"date":"2026-05-01T20:21:42","date_gmt":"2026-05-01T20:21:42","guid":{"rendered":"https:\/\/login9ja.com\/global\/kim-kardashians-skims-sued-by-designer-over-fits-everybody-name\/"},"modified":"2026-05-01T20:21:42","modified_gmt":"2026-05-01T20:21:42","slug":"kim-kardashians-skims-sued-by-designer-over-fits-everybody-name","status":"publish","type":"post","link":"https:\/\/login9ja.com\/global\/kim-kardashians-skims-sued-by-designer-over-fits-everybody-name\/","title":{"rendered":"Kim Kardashian&#8217;s SKIMS sued by designer over Fits Everybody name"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/login9ja.com\/global\/wp-content\/uploads\/2026\/05\/wp-content\/uploads\/sites\/3\/2026\/05\/126792545.jpg\" \/><\/p>\n<div>\n<p>Kim Kardashian\u2019s iconic SKIMS brand is being sued by a small New York designer over the shapewear label\u2019s use of the \u201cFits Everybody\u201d name.<\/p>\n<p>In the 43-page trademark infringement lawsuit \u2014 which was filed on March 31 in the Southern District of New York on behalf of Denise Cesare \u2014 Fits Everybody To A T claims SKIMS went ahead with launching its Fits Everybody collection even \u201cafter receiving repeated, unequivocal notice\u201d of their rights.<\/p>\n<p>It also alleges that Kardashian\u2019s wildly <a href=\"https:\/\/pagesix.com\/2026\/01\/28\/style\/kim-kardashian-strips-down-to-lacy-skims-lingerie-ahead-of-valentines-day\/\">popular lingerie brand<\/a> identified \u201ca trademark owned by a small, self-funded woman-owned business\u201d and recognized that \u201cthe small business owner would likely lack the resources to fight back.\u201d <\/p>\n<p>Cesare is seeking an order barring SKIMS from continuing use of the name, as well as damages including legal costs and profits.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>Kim Kardashian\u2019s SKIMS brand has been sued by a smaller business over the use of \u201cFits Everybody\u201d for their \u201cbest-selling\u201d collection. She\u2019s seen above in an April 3 Instagram photo.  <span class=\"credit\">fitseverybody\/Instagram<\/span><\/figcaption><\/figure>\n<aside class=\"single__inline-module aligncenter wp-block-nypost-editor-primary-tag\">\n<\/aside>\n<p>Lawyers for the small business accused SKIMS of making a \u201ccalculated decision\u201d to use the name anyway, \u201crelying on its overwhelming financial resources, <a href=\"https:\/\/pagesix.com\/2026\/02\/11\/style\/kylie-jenner-strips-down-for-new-skims-underwear-campaign\/\">celebrity connections<\/a>, and marketing machine to simply crush\u201d Fits Everybody To A T \u201cout of existence\u201d in the docs.<\/p>\n<p>\u201cDefendant believes it could simply outspend, out-market, and outlast any legal challenge from a small business owner,\u201d the documents read. <\/p>\n<p>The reality TV icon <a href=\"https:\/\/pagesix.com\/2019\/09\/11\/kim-kardashian-made-2m-in-minutes-with-skims-shapewear-launch\/\">launched her $5 billion dollar SKIMS brand in 2019<\/a>, while Cesare\u2019s brand has been selling apparel and swimwear under the Fits Everybody To A T name for nearly ten years.<\/p>\n<p>Among the petitioner\u2019s concerns is that SKIMS\u2019 use of \u201cFits Everybody\u201d is likely to cause \u201cconfusion\u201d and threatens to \u201coverwhelm\u201d the smaller company\u2019s \u201cbrand identity.\u201d<\/p>\n<p>The documents also state that in search engine results, the smaller brand has become \u201ceffectively invisible\u201d as a result of the similar names. <\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>The March 31 filing accused SKIMS of using the name even \u201cafter receiving repeated, unequivocal notice.\u201d <span class=\"credit\">Skims<\/span><\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>Lawyers for Cesare (seen above in a January snapshot) of \u201cadopting a confusingly similar name\u201d and eclipsing her smaller company.  <span class=\"credit\">denise.cesare\/Instagram<\/span><\/figcaption><\/figure>\n<p>\u201cThe complaint, which is publicly available, tells the story of our client \u2013 a small, self-funded business founded and run by Denise Cesare, its sole owner and operator,\u201d Cesare\u2019s attorney, Jessica Mathews, <a href=\"https:\/\/www.dailymail.com\/tvshowbiz\/article-15773437\/Kim-Kardashians-Skims-empire-sued-small-time-designer-claims-hijacked-swamped-business.html\" target=\"_blank\" rel=\"noopener\">told the Daily Mail<\/a> in a statement. <\/p>\n<p>The statement also noted that Cesare \u201cbuilt her brand from the ground up, years before SKIMS entered the market.\u201d<\/p>\n<p>\u201cWhat followed, as alleged, is a textbook case of reverse confusion: a far larger, <a href=\"https:\/\/pagesix.com\/2025\/07\/14\/style\/kris-jenner-oprah-and-gayle-king-model-skims-x-roberto-cavalli-caftans-on-a-yacht\/\">celebrity-backed <\/a>company adopting a confusingly similar name and rapidly saturating the market through scale, advertising, and the cultural reach of its co-founder, Kim Kardashian,\u201d the statement continued. <\/p>\n<p>They added, \u201cWe asked them to stop using her mark almost two years ago\u201d and claimed that \u201cthey refused.\u201d Cesare has two active federal trademarks, in 2016 and 2024.<\/p>\n<p>\u201cThe USPTO then refused to register their mark twice because of our client\u2019s registered mark,\u201d Mathews told the outlet.<\/p>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>Cesare seeks damages and an order for SKIMS to stop using the name.<\/figcaption><\/figure>\n<figure class=\"nyp-slideshow-modal-image wp-block-image aligncenter size-full\"><figcaption>\u201cTrademark law doesn\u2019t care how big you are or how many followers you have,\u201d an attorney for Cesare told the Daily Mail. Kardashian is seen above modeling a bodysuit from her brand.  <span class=\"credit\">Instagram\/Skims<\/span><\/figcaption><\/figure>\n<p>The SKIMS application was declined by the USPTO in December based on what Trademark officials called a \u201clikelihood of confusion.\u201d<\/p>\n<p>Kardashian\u2019s company filed for a three-month extension in March amid a six-month response deadline, with Cesare filing a federal lawsuit at the conclusion of last month. <\/p>\n<p>\u201cTrademark law doesn\u2019t care how big you are or how many followers you have,\u201d Mathews\u2019 statement to the outlet concluded. \u201cIt cares about who was first to use the mark.
