Couple avoid jail after leaving baby alone on beach and ‘losing track of time’

Both the baby’s mum and dad were both charged with child neglect without great bodily harm after they walked off and left their six-month-old baby asleep on the sand

A mum and dad who left an infant alone on a Florida beach have dodged jail time on charges of child neglect, with charges against the parents dropped after they reached an out-of-court agreement with prosecutors. Parents Brian, 40, and Sara Wilkes, 37, were arrested in October in 2025 after beachgoers called the police following reports that a baby had been left unattended on the sand at Miramar Beach. When police arrived, the parents still had not returned to check on or to claim their child, who was by that point being cared for by Good Samaritans at the nearby Hilton Sandestin Beach Golf Resort and Spa. As police waited for paramedics to arrive at the scene, the couple wandered back to where they had abandoned their six-month-old baby girl. They confessed to police the baby was theirs and that they had left her there alone, police confirmed.

Mr and Mrs Wilkes admitted they had placed their daughter under the cover of their beach tent while she napped. The parents then took their three other children on a walk and “lost track of time”, officials said last October. Neither Brian nor Sara took their phones with them as they went walkabout with their other children, surveillance footage showed. Luckily, the six-month-old baby girl was unharmed, with paramedics confirming that her vitals were normal, and she was not in distress, despite being abandoned by her family. Major Dustin Cosson with the Walton County Sheriff’s Office described the amount of time the couple left their child alone was “‘way longer than what would be reasonable”. The baby had been left alone for “at least an hour” when 911 was called. Cosson told ABC13 that, while he can understand the importance of a sleep schedule for both babies and parents, that does not mean parents should ever leave their child alone during nap time.

“That’s all fine and dandy, but you don’t just leave a baby at a house and then leave and go off to the store,” he said. “The baby could roll over and suffocate itself, or the wind could blow a towel over its face. There’s no telling what could have happened.” He added that, while beaches bordering America’s Sunshine State may be family-friendly places for families and children, the beach is not a babysitter; meaning parents still need to use their common sense and watch their children. “Yes, it’s a bubble, but that doesn’t mean as you cross over the county line or over the state line into Florida that we can just leave your common sense behind,’ he said, of the couple from Houston, Texas. The Florida Department of Children and Families were called and all children in the care of the Wilkes’ were placed in state custody until relatives from Texas could arrive to care for them.

But now it seems both parents have dodged jail after entering into a deferred prosecution agreement in May, as per court documents seen by the Daily Mail. As per legal filings, the couple had to each pay £754 (USD$1,000) in fines, work 25 hours of community service, attend a parenting class, and are now barred from visiting Walton County, Florida. All conditions must be met within a year of the agreement being struck, legal documents confirmed. The parents are also on a good behaviour warning, meaning they must steer clear of trouble with the law or the court will resume neglect proceedings against them. The conditions all have to be met within a 12-month period, and they must remain out of trouble otherwise they will be taken back to court and their case reopened.
